Seller Delayed Shipping Your Bag? The 30-Day Rule

Sellers must ship on time or give you a delay notice and the right to cancel with a full refund.

Typical situation

You ordered a bag online and the seller has just emailed to say the shipment will be late. You want to know what your rights are, and whether you can cancel.

Main answer · berabags Editorial Team · Consumer-rights view

In the US, a seller must ship your order within the time it promised, or within 30 days if it did not state a time, and if it cannot, it must tell you and give you the chance to cancel with a full refund. This is the FTC’s Mail, Internet, or Telephone Order Merchandise Rule, sometimes called the 30-day rule.

What the seller must do

  • Have a reasonable basis for any shipping time it states.
  • If it learns it cannot ship on time, notify you of the delay, give a new shipping date, and explain your right to cancel for a full and prompt refund.
  • For a definite delay of up to 30 days, the seller may treat your silence as agreement. For longer or open-ended delays, and for second and later delays, it needs your consent.
  • If you do not consent, the seller must promptly refund what you paid for the unshipped goods, without being asked.

What you should do

  1. Read the notice and note the new date.
  2. If you do not want to wait, reply in writing to cancel, and ask for a refund to your original payment method.
  3. If you agree to wait, say so, and keep the message.
  4. Keep the order confirmation and any screenshot of the promised shipping time.

If no refund comes

Contact the seller again in writing. The FTC advises that if you cannot resolve the problem, you contact the company you paid with to dispute the charge, and report the seller at ReportFraud.ftc.gov.

Where this answer stops

This covers the FTC rule for goods ordered by mail, phone or internet in the US, as described on the FTC site. Rules in other countries differ. This is not legal advice.

Look for the promised shipping time before you order, and keep a screenshot of it. If a seller states no time, the 30-day limit applies. A listing that says “ships in 2 days” is a promise you can point to later.

For a bag you need by a date, such as a trip, choose a seller with a clear shipping time and tracking. A cheaper price from a seller who is vague about shipping can cost more if you have to buy a second bag.

Answer a delay notice in writing and say what you want: a refund or to wait. Silence can be treated as agreement to a short delay in some cases, so do not ignore it if you do not want to wait.
